Next Level Ecommerce LLC provides website design, development, and ecommerce optimization services. Our engagement process operates as follows:

All prices for services are agreed upon in writing between Next Level Ecommerce LLC and the client before any work commences. Prices are quoted in US Dollars (USD) unless otherwise agreed.

Payment is due in full upon client approval of the pre-design preview and prior to commencement of full development. Next Level Ecommerce LLC reserves the right to withhold delivery of completed work until payment has been received in full.

All website designs, mockups, code, and deliverables created by Next Level Ecommerce LLC remain the intellectual property of Next Level Ecommerce LLC until payment has been received in full.

Upon receipt of full payment, all intellectual property rights to the completed deliverables transfer to the client. Pre-design previews provided free of charge remain the property of Next Level Ecommerce LLC unless and until payment is received.

The client agrees to provide accurate and complete information necessary for the completion of the project, including but not limited to: brand assets, content, hosting credentials, and any third-party account access required for deployment.

Next Level Ecommerce LLC shall not be held liable for delays arising from the client’s failure to provide required information in a timely manner.

Our services are provided “as is” and “as available” without any representation or warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Next Level Ecommerce LLC does not warrant that the services will be uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent permitted by applicable law, Next Level Ecommerce LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with these Terms of Service or the use of our services.

In no event shall our total liability to you exceed the amount paid by you to Next Level Ecommerce LLC in the six (6) months preceding the claim.

Both parties agree to keep confidential any proprietary information, trade secrets, or business details shared during the course of the engagement. This obligation of confidentiality shall survive the termination of any agreement between the parties.

Either party may terminate a service engagement at any time prior to the client’s written approval of the pre-design preview, with no financial obligation to either party.

Once the client has approved the pre-design preview and payment has been made, the project is considered committed and no refunds will be issued. Next Level Ecommerce LLC reserves the right to terminate service at its discretion for violations of these Terms of Service.

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the United States and the state in which Next Level Ecommerce LLC is registered, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located within that state.

Next Level Ecommerce LLC reserves the right to update, change, or replace any part of these Terms of Service at its sole discretion. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
